SKEMI TA’ L-ALLINJAMENTI
Skont l-Artikolu 38(1)(f) tal-Kap 552 tal-Ligijiet ta’ Malta, il-funzjoni ‘sabiex jirregola skemi ta’ allinjament u ta’ livelli kif ukoll li jinterpretahom fis-sit’ hija fdata f’idejn il-Kunsill Ezekuttiv. Dak li jigri fil-prattika huwa li l-official zoning u official scheme alignment jigu konfermati mill-Alignment Interpretation Section fi hdan id-Direttorat ta’ l-Ippjanar. Kwindi, minn hawn jemergi li hija l-Awtorita’ ta’ l-Ippjanar (u mhux, gratia argumenti, Transport Malta) li ghandha l-vires fuq l-allinjamenti u l-livelli topografici tat-toroq.
B’danakollu, Transport Malta xorta wahda ma tithalliex fl-ghama. Infatti, kull applikazzjoni ta’ zvilupp komplet tghaddi ghand Transport Malta qua konsulent estern[1]. B’mod kostanti, tista’ tghid li r-rejazzjoni ta’ Transport Malta tkun is-segwenti:
‘Transport Malta is of the opinion that the proposal in caption should be assessed in line with Planning Authority’s DC2015 Guidelines and/or relevant policy documents. The proposed development should be within the official scheme alignment, UCA building line and/or the established site boundary and should not encroach onto the public road space….’
Dak li tinsisti Transport Malta hawn huwa li m’ghandhomx jigu permessi strutturi ‘l barra mill-allinjament uffiċjali u, jew, aghar minn hekk, kompletament fi triq skemata b’tali mod li jippreġudikaw lil terzi mid-dritt t’aċċess għas-sit tagħhom, anke jekk it-triq ma tkunx għadha kompletament miftuħa. Ma jistax, ghalhekk, wiehed jargumenta li ser izomm struttura fi triq skemata sakemm din tinfetah.[2]
ACCESSI FUQ DISTRIBUTOR ROADS
Hawnhekk, ir-rwol ta’ Transport Malta jista’ jidher izjed accentwat anke jekk l-Objettiv Tematiku 10.4 tal-iStrategic Plan for Environment and Development [SPED] u l-Policy P14 tal-Linja Gwida DC15 jghajjtu lill-Awtorita’ ta’ l-Ippjanar. Dawn jghidu hekk:

‘No direct vehicular access will be allowed onto, or out of, arterial or distributor roads, as designated by the competent transport authority, unless such access is authorised by such authority.
Where an arterial or distributor road is flanked by a service road, then vehicular access to development will be designed to occur directly onto such service road, and from there, at a limited number of points, onto the arterial or distributor road. In these cases, vehicular accesses will only be considered where vehicles may enter and exit the service road in a forward gear and in a single manoeuvre.
The conversion of existing ill-situated garage openings will be favourably considered provided that the replacement use does not result in an adverse traffic impact’.
Ergo, l-Awtorita’ ta’ l-Ippjanar ghandha l-politika taghha dwar aċċessi li jkunu diretti għal distibutor road li ser jiġġeneraw moviment tal-karozzi addizjonali illi sejjer iwassal għal żieda potenzjali ta’ perikolu tat-traffiku u b’impatt negattiv fuq moviment ħieles u sigur tat-traffiku.
Id-differenza hawn pero’ hija l-htiega ta’ clearance ta’ Transport Malta sabiex permess ta’ zvilupp fejn ser ikun hemm access fuq distributor road jirnexxi.[3]
Dan precizat, l-analizi li trid twassal ghal clearance o meno da parti ta’ Transport Malta ghandha tkun imsejsa fuq l-istat ta’ fatt fit-triq ezistenti fil-jum tad-decizjoni, u cioe’ fuq dawk il-‘fatti accertati b’mod konkret u cioe’ jekk qabel kollox l-istat attwali tat-triq hix mizura permanenti jew temporanja’.[4]
