One of the significant challenges encountered in planning applications is the requirement by the Planning Authority to provide on-site parking, which applicants may prefer to allocate for other purposes. Another issue arises when the ownership of a garage is separate from the apartments above; despite this, applicants who own the garage are still mandated to leave the parking available for the above dwellers, thereby restricting the use of their garage. Furthermore, the Planning Authority may determine that a proposed space is too large for a change of use without incorporating adequate parking facilities, even though no parking is available on site. Are there solutions to these complex issues? Is it possible to negotiate a planning gain instead?
